A 2015 update to the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (Fines on Summary Conviction) Regulations has brought into force Section 85 of the original 2012 Act. This update changes the limit on certain fines that can be imposed by a magistrates’ court. Before the 12thof March 2015, the maximum fine on conviction in a magistrates’ court was £20,000 for breaches of the Health and Safety at Work Act 1974.
For offences committed on and after the 12th of March 2015, the maximum penalty in the magistrates’ court is an unlimited fine. There are a number of health and safety related issues that are affected by this change including:
- Certain breaches of the Health and Safety at Work Act 1974
- Breaches of the Employers’ Liability (Compulsory Insurance) Act 1969
- Maximum award of compensation orders
